1. Scope
These general terms and conditions (T&C) apply to all contracts between DotLine GmbH (hereinafter “Seller”) and its customers for the purchase of timing systems, components and accessories, unless expressly agreed otherwise.
Deviating terms of the customer are not recognised unless the Seller expressly agrees to their validity in writing.
2. Conclusion of contract
The presentation of products on the website does not constitute a legally binding offer, but a non-binding invitation to place an order.
By submitting the order form, the customer makes a binding offer to purchase the selected goods.
The contract is only concluded by a written order confirmation (by e-mail) or by delivery of the goods.
3. Prices and shipping costs
All prices are gross prices including German statutory VAT (19%).
Shipping costs are charged in addition; the customer will be informed of the amount before the contract is concluded.
For deliveries abroad, additional customs duties, taxes or fees may apply, which are borne by the customer.
4. Terms of payment
Payment is made – depending on the offer – for example by:
- prepayment / bank transfer
- invoice
The Seller reserves the right to exclude certain payment methods in individual cases.
Unless otherwise agreed, the invoice amount is due without deduction within 14 days of the invoice date.
5. Delivery and shipping
Deliveries are made to the address specified by the customer.
Unless otherwise stated, the delivery time within Germany is 3–7 working days after receipt of payment or order confirmation.
If an item is not available, the customer will be informed immediately.
The risk passes upon handover to the customer. For entrepreneurs, § 447 BGB applies (transfer of risk upon handover to the shipping service provider).
6. Retention of title
The goods delivered remain the property of the Seller until all claims arising from the contract have been paid in full.
7. Warranty
For consumers, the statutory warranty period of 2 years from delivery applies.
For entrepreneurs, a warranty period of 12 months applies.
The warranty does not apply if damage is caused by improper use, external influences, improper installation or interference with the devices.
8. Liability
The Seller is liable without limitation for:
- intent or gross negligence
- injury to life, body or health
- claims under the German Product Liability Act
In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
Any further liability is excluded.
9. Right of withdrawal (consumers only)
Consumers have a 14-day right of withdrawal in accordance with statutory provisions.
The right of withdrawal does not apply to individually manufactured or configured products (e.g. special customer-specific settings in the timing system).
Detailed information on the right of withdrawal is provided separately in our cancellation policy.
10. Data protection
The Seller processes the customer’s personal data exclusively in accordance with the applicable data protection laws.
Data is only passed on to third parties where this is necessary to perform the contract (e.g. shipping service providers).
Further information can be found in the privacy policy.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the customer is an entrepreneur, the exclusive place of jurisdiction is the Seller’s registered office.
Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
